Terms of Service

These terms govern your use of the Tunelo website, our consulting and web design services, and our WhatsApp Business integration. By engaging us or connecting an account, you agree to these terms.
1. Who we are
Tunelo is operated by Spectrum Holdings (Pty) Ltd, registration 2026/298503/07, based in Cape Town, South Africa. Contact: hello@tunelo.co.za.
2. Services
We provide web design, AI consulting, and a WhatsApp Business integration that lets you send and receive messages through the official WhatsApp Business Cloud API. Specific deliverables, timelines, and fees for consulting work are set out in a separate written proposal or invoice.
3. WhatsApp Business integration
- You must own or be authorised to manage the WhatsApp Business Account you connect.
- By connecting, you accept Meta’s WhatsApp Business Solution Terms and acknowledge that Meta is the underlying messaging provider.
- You are responsible for the content of messages you send and for complying with WhatsApp’s commerce, messaging, and template policies.
- We may suspend the integration if Meta requires it or if your usage poses a security or compliance risk.
4. Acceptable use
You agree not to use Tunelo to:
- Send unsolicited bulk messages or content prohibited by WhatsApp.
- Impersonate another person or business.
- Infringe intellectual property or violate any law applicable in South Africa.
- Attempt to access systems or data you are not authorised to access.
5. Fees and payment
Consulting and web design fees are quoted in writing before work begins. Invoices are payable in ZAR within 7 days unless agreed otherwise. WhatsApp messaging fees charged by Meta (per-conversation) are passed through at cost or included in your plan, as set out in your engagement letter.
6. Termination
Either party may end the relationship in writing. On termination we will, within 30 days, delete your WhatsApp connection credentials and stored message content unless retention is required by law. Outstanding invoices remain payable.
7. Liability
We provide the services with reasonable skill and care. To the maximum extent permitted by South African law, our aggregate liability for any claim arising out of these terms is limited to the fees you paid us in the 6 months preceding the claim. We are not liable for indirect or consequential loss, lost profits, or loss of data caused by Meta or any other third-party provider.
8. Privacy
Personal information is handled in accordance with our Privacy Policy.
9. Changes
We may update these terms; the “Last updated” date at the top reflects the current version. Material changes that affect existing engagements will be notified by email.
10. Governing law
These terms are governed by the laws of the Republic of South Africa. The courts of the Western Cape have exclusive jurisdiction over any dispute.
